Terms of Service
Plain-language terms for using NeverMiss. By starting a trial or subscription, you agree to them.
The service
NeverMiss provides missed-call text-back, an AI voice and text assistant, lead capture and follow-up, and estimate and invoice reminders for small businesses. The service is in early access, so features may change as we improve them.
Free trial
New accounts get 14 days free with no payment card. At the end of the trial, you can pick a plan or let the trial end, and no charges happen unless you choose a plan.
Plans and billing
Plans are billed monthly or yearly in advance, in U.S. dollars. There are no setup fees and no long-term contracts. You can cancel any time, and service continues until the end of the paid period. If you go over your voice minutes, extra minutes are billed at the rate shown in your account.
The Missed-Job Promise
If NeverMiss doesn't recover at least one job, booking or order that you would otherwise have missed during your first 30 paid days, tell us within 15 days after that period ends and we'll refund your first month's fee. A "recovered" job is a booking, appointment, order or signed estimate that came from a call, text or lead NeverMiss handled.
Your responsibilities
- Give accurate business information. The assistant answers from what you provide.
- Use NeverMiss only to contact people who called, texted or asked your business for contact, and follow applicable laws, including the TCPA, carrier messaging rules and call-recording consent laws. The recording announcement is on by default. If you turn it off, you're responsible for getting consent where required.
- Don't use NeverMiss to send spam, harass anyone, or send unlawful, deceptive or harmful content.
- Keep your login secure and tell us about any unauthorized access.
AI responses
The assistant is designed to answer only from your information and to take a message when it's unsure. But AI can make mistakes. Review conversations and settings, and don't rely on it for emergencies, legal, medical or safety advice.
Your data
You own your data and your customers' data. You give us permission to process it only to provide the service, as described in our Privacy Policy.
Availability
We work to keep NeverMiss available 24/7, but outages can happen, including at our phone, text or AI providers. Calls that can't be handled continue to ring through to your phone or voicemail as usual.
Limitation of liability
To the extent the law allows, NeverMiss isn't liable for indirect or consequential damages or lost profits. Our total liability for any claim is limited to the fees you paid in the 3 months before the claim.
Ending the service
You can cancel at any time. We may suspend accounts that break these terms or put others at risk. After cancellation, you can export your data for 30 days, and then it's deleted.
Governing law
These terms are governed by the laws of the State of Illinois, USA.
